8/28/2009

Lathrop Gage attorneys Brian Myers (Insurance - Kansas City) and Jennifer McAdam (Insurance - Kansas City) are featured authors in the latest edition of the esteemed guide New Appleman on Insurance -- Current Critical Issues in Insurance Law, recently published this summer. Their article, "Recent Developments in Insurance Law on Notice: The Continuing Trend Toward Requiring Prejudice," focuses on recent developments in the law regarding the defense of late notice. New Appleman on Insurance is published by LexisNexis Matthew Bender and offers comprehensive and rigorous analysis from top practitioners nationwide from the field of insurance law.

"When an insured fails to notify its insurer in a timely manner, the insurer may assert a coverage defense of late notice," the authors write in their article. "Because courts and legislatures around the country have adopted varying approaches to the late notice defense, it is imperative for coverage counsel and other claim professionals to know the applicable law when addressing this issue."

For nearly 30 years, Mr. Myers has represented local and national companies in complex business litigation, arbitrations, and mediations. He has extensive experience in insurance, real estate, and contract claims. He has served as lead counsel in many major commercial cases, including insurance coverage claims, commercial lease disputes, contract cases, and fraud claims.

Most of Mr. Myers current practice is devoted to insurance coverage matters, with a particular focus on Lloyd's and London Market coverage issues. He has been chief counsel in a number of negotiations in London on behalf of policyholders, and has obtained substantial recoveries from "insolvent" London insurers. He also serves as Chair of the firm's Professional Responsibility Committee, and has served as Director of the firm's Business Litigation Department. Ms. McAdam is an associate in the insurance department, concentrating her practice in assisting corporate policyholders in handling and litigating a broad range of insurance disputes. Ms. McAdam served as law clerk to the Honorable Ronald Holliger, Missouri Court of Appeals from 2007 to 2008.
