Andrew Y. Choung

Andrew Choung is an accomplished patent attorney.  His primary focus is on high-tech, complex patent litigation and Patent Trial and Appeal Board proceedings such as inter partes review.  Andrew also provides strategic counseling to clients on the development of licensing and monetization programs, patent portfolio development, acquisitions and licensing, and IP due diligence. Having experience practicing law in both the United States and Asia, Andrew has assisted and counseled clients on cross-border matters, including multi-country patent enforcement.

Andrew represents a wide range of clients, with a focus on Korean universities, research institutes and companies.  His clientele cover various high-tech fields including telecommunications technologies, display and display materials technologies, semiconductors and semiconductor manufacturing equipment, automotive and aeronautical technologies, software, internet technologies, business and financial methods, PC games, and virtual worlds and assets. 

In addition to authoring and co-authoring articles on intellectual property laws, Andrew is a frequent speaker on patent defense, monetization and development topics.

Prior to joining Lathrop Gage, Andrew practiced law at prestigious law firms in both the United States and Korea. In addition, he was a shareholder and founding member of a boutique firm specializing in patent litigation and monetization programs.

  • Won $400 million verdict in jury trial representing a university-based licensing entity in a patent-assertion action over FinFET technology. KAIST IP US LLC v. Samsung Electronics Co., LTD., et al
  • Secured vacatur of multi-million dollar judgment against Korean marine electronics company and dismissal of infringement claims involving marine GPS technologies. Condatis v. Arcturus, et al
  • Obtained favorable settlement and disposition on behalf of Korean manufacturer of x-ray devices in patent declaratory judgment action. Dexcowin Global, Inc. v. Aribex, Inc.
  • Defended several banks and financial institutions against claims of infringement involving various checking imaging patents. Datatreasury v. Remitco, et al and Datatreasury v. Wells Fargo, et al 
  • Defended client against claims of trademark, copyright and trade secret violations in conjunction with a breach of a license agreement lawsuit. DTS Inc. v. Nero AG
  • Won summary judgment of noninfringement for a Korean manufacturer of outdoor activity equipment and supplies against three patents directed to clip-lights. Foundton, Co. Ltd v. Naschem Co., Ltd. et al
  • Defended client against claims of infringement over patent for visual aid device. Freedom Scientific v. HIMS 
  • Won summary judgment of noninfringement of nine JVC Kenwood optical disc patents for client Nero, based on patent exhaustion. JVC Kenwood Corp. v. ArcSoft Inc., et al 
  • Represented licensing entity in enforcement of location-based triggering technology. Locata LBS LLC v. YP.com, et al 
  • Represented Korean mobile device developer in dispute over misappropriation of trade secrets. M Seven System v. Leap Wireless et al 
  • Represented licensing entity in its assertion of trading and market-related technology. Markets-Alert Pty Ltd. v. The Charles Schwab Corp., et al
  • Represented manufacturer of MRI safety devices in dispute over ferromagnetic detection technology. Mednovus Inc. et al v. Qinetiq Ltd, et al 
  • Represented client in declaratory judgment action against licensing entity, including a successful reexamination against the asserted patent. Polystak v. Entorian
  • Represented licensing entity in its assertion of CDMA related patents sourced from a renowned Korean research institute. SPH America, LLC v. Acer, Inc. et al and SPH America, LLC v. Apple, Inc. et al 
  • Represented Korean MP3 company in defense of infringement claims involving MP3 technologies. Tsera, LLC v. Apple, Inc. et al 
  • Represented licensing entity in its assertion of core WiFi standard-essential patents. Wiav Networks v. 3Com, et al
  • Represented licensing entity in its assertion of 3G and GSM standard-essential patents. WiAV Solutions, LLC v. Motorola, Inc. et al and WiAV Solutions, LLC v. RIM, Ltd., et al
