Amy Burke

Amy Burke is an associate in the firm's Los Angeles office who focuses her practice on business litigation and intellectual property matters. She is experienced in advising clients on trademark and copyright protection and enforcement, contract disputes, false advertising, unfair competition, and employment matters.

Amy offers practical solutions and executes effective strategies to protect and defend her clients' intellectual property. She also advises businesses on regulatory compliance and key contracts, as well as product labeling and advertising.

Representative Matters

  • Brought motion for summary judgment on behalf of a major online retailer in copyright infringement action on the ground of impossibility of access, resulting in a voluntary dismissal of the action with prejudice
  • Achieved favorable settlement for plaintiff brand owner after moving for preliminary injunction in trademark infringement action
  • Successfully prosecuted application for registration of trademark in fragrance of personal care products, one of four fragrance marks ever registered on the Principal Register
  • Won motion for summary judgment in trademark infringement action disposing of affirmative defense of fraud on the U.S. Patent and Trademark Office
  • Achieved favorable settlement for defendant clothing distributor in copyright infringement action after filing a motion for summary judgment attacking the validity of plaintiff's copyright
  • Successfully defended employers against claims for unpaid overtime wages and rest period penalties before Labor Commissioner
  • Prevailed in motion to dismiss out-of-state client from jewelry design copyright and trademark infringement action for lack of purposeful direction toward California plaintiff
  • Represented personal care product manufacturer in multi-million dollar acquisitions of worldwide intellectual property rights
  • Managed domestic and international trademark portfolios for high-profile personal care product and consumer goods manufacturers
