Thomas H. Curtin

Experience
Mr. Curtin has extensive experience in a wide variety of intellectual property issues, particularly in trademark, unfair competition and copyright matters.

Mr. Curtin has represented Fortune 500 companies in federal courts and before the U.S. Patent and Trademark Office protecting their intellectual property portfolios.  He has litigated cases involving claims of trademark infringement, unfair competition, false advertising, dilution, cybersquatting, trade dress infringement, counterfeiting and copyright infringement.

Mr. Curtin's practice also includes counseling clients on trademark matters, from search and clearance of marks, to prosecuting applications before the U.S. Patent and Trademark Office and litigating opposition and cancellation proceedings before the Trademark Trial and Appeal Board.  He is also involved in licensing, internet-related issues and has supervised trademark litigation worldwide.

Representations and experiences include:
  • Succeeded in dismissing on summary judgment a suit for copyright infringement and related common law claims against a Fortune 50 transportation and delivery company.
  • Successfully argued for a preliminary injunction against a cybersquatter utilizing the principal mark of a well-known children's clothes retailer and assisted in the successful affirmation on appeal and subsequent summary judgment motion.
  • Conducted seizure raids on Canal Street in New York City to stop the sale of counterfeit luxury brand watches.
  • Succeeded in obtaining domain names from cybersquatters through litigation and enforcement efforts including the corresponding domains for many well-known household brand names.
  • Successfully obtained a consent judgment against a third party from using packaging in its eye drop product that mimicked the well-known trade dress of the leading brand.

Mr. Curtin has presented on trademark dilution issues before the New York State Bar Association and wrote on that subject for the Bright Ideas publication put out by the New York State Bar Association.

Previously, Mr. Curtin was a partner with the firm of Nims, Howes, Collison, Hansen & Lackert and counsel with King & Spalding.
