Mr. McCartan represents clients in litigated and non-litigated business-to-business disputes such as breach of contract matters, loan enforcement actions, construction matters, insurance disputes, regulatory matters, business torts and professional liability matters.

• Resolved consumer class action involving an alleged unlawful fee with client paying no damages.
• Obtained order denying class certification of a proposed 18-state class action involving consumer claims in the title insurance industry.
• Secured dismissal of consumer protection claim alleging that financial institution had violated the Federal Truth-in-Lending Act.
• Secured dismissal of consumer protection claim alleging that finance company had overcharged customer in a financing transaction.
• Secured judgment for financial institution against debtor asserting defense under Regulation B of the Equal Credit Opportunity Act.
• Received summary judgment on claim that finance company’s collection action constituted a malicious prosecution against the debtor.
• Achieved dismissal of multiple claims in action arising out of a company’s unsuccessful bid for a public contract.
• Blocked the certification of a class action, and won final dismissal of constitutional claims in lawsuit involving public official.
• Achieved dismissal of claims of negligence, breach of contract, and breach of fiduciary duty, as well as enforcement of a limitation-of-liability clause, in lawsuit involving complex health care and computer systems.
• Successfully asserted constitutional claims to enable the construction of a health care facility in Missouri.
