Employment Litigation.  In addition to our wide experience with class, collective and multiple plaintiff lawsuits, our firm’s attorneys have a proven national track record with respect to discrimination, harassment and retaliation defense. We deal efficiently and effectively with the common law world of employment complaints, from wrongful discharge, whistleblowing, assault and battery, false imprisonment, misuse of social media, invasion of privacy and defamation to negligent hiring, supervision and training. We appear before and litigate against federal agencies such as the EEOC and United States Department of Labor (DOL), and their innumerable state and local counterparts.

Compensation.  Salaries and wages are usually a business’s greatest line-item operating expense. We have attorneys with vast experience in Fair Labor Standards Act (FLSA) wage and hour class and collective actions, accompanying state laws, and other statutes governing employee compensation. In California, we possess unique experience in the restaurant industry, a particularly hot battleground. We also frequently draft executive agreements for the C-suite.   

Advice & Counsel.  Providing advice and counsel to employers is our bread and butter. We do it all, from comprehensive audits to day-to-day HR guidance. With a cadre of experienced employment attorneys, we are on the front line when new issues like mandatory paid leave and municipal minimum wage laws arise, or a new type of litigation takes hold, such as Fair Credit Reporting Act (FCRA) class actions. 

Handbook & AAP Programs.  We have a National Handbook Program, so our clients’ human resources professionals have a dependable mechanism to stay up-to-date with the latest changes. We have a similar annual review program for Affirmative Action plan compliance, and routinely handle OFCCP matters.

Labor Relations.  We regularly handle National Labor Relations Board (NLRB) and other traditional labor matters, such as union campaigns and elections, grievance and arbitration proceedings, unfair labor practices, collective bargaining negotiations and strikes.

Non-Competes et al. With respect to non-compete, non-solicit and confidentiality agreements, enforcement varies widely from state to state, and we often advise our clients on the risks (and benefits) of hiring executives and high-value salespeople who come with such restrictions in hand. Likewise, we enforce these agreements when necessary to prevent, stop and remedy breaches by former employees and contractors. Our attorneys are knowledgeable regarding the data security, privacy and e-discovery issues that typically accompany these claims and related trade secret disputes. 

Immigration. We have a robust immigration practice, with an emphasis on helping employers follow the rules necessary to obtain and keep talent not otherwise available within our borders, through the H1-B Visa program and other avenues governed by the United States Citizenship and Immigration Services (USCIS).

OSHA.  We have experience in dealing with the most difficult of Occupational Safety and Health Act citations, including the tragic circumstances of fatalities. The construction and manufacturing industries are among those to whom we provide the most services with respect to safety prevention and incident response.

ELA.  Our firm is the select member (for Missouri and Kansas) of the Employment Law Alliance, the world’s largest network of employment lawyers. It offers the most comprehensive and cost-effective way for multi-national employers to ensure legal compliance around the globe.
