Travis W. McCallon

Mr. McCallon focuses his practice on intellectual property counseling and litigation, primarily concerning patents, trademarks, copyrights, and trade secrets. He represents clients in a wide range of industries, from biotechnology to consumer products. He also represents emerging entrepreneurs in their effort to secure valuable protection for their brands and technologies. Mr. McCallon has participated in multiple multi-week jury and bench trials involving a range of intellectual property issues, and has served as the lead brief-writer for a number of high-profile cases and appeals.

Mr. McCallon is well-versed in case theory analysis and development, as well as the development and execution of discovery and case management techniques. He is skilled in legal analysis and writing, and enjoys the challenge of articulating an argument in a persuasive and creative way.

  • Represent client in prosecution of patent infringement action involving highly sophisticated human-gene and -protein patents.
  • Represent national client in defense of patent infringement action involving children’s lighted shoes.
  • Represent national client in prosecution and defense of false advertising action involving “tests prove” advertising claims for infant care products.
  • Represent national client in successful defense of appeal (affirming denial of preliminary injunction) before the Ninth Circuit in case involving “tests prove” advertising claims for infant care products.
  • Represent international client in successful defense of declaratory judgment action involving patent for charm jewelry.
  • Assisted client in successful appeal (reversing summary judgment order) before the Federal Circuit in case involving patent for remote alcohol monitoring devices.
  • Assisted client in prosecution of patent infringement action involving chemical formulas for commercial road de-icers.
  • Assisted national client in defense of trademark and trade dress action involving athletic shoe designs.
  • Assisted national client in successful defense of patent infringement proceeding before the International Trade Commission involving rubber clog shoes.
  • Advised client and lobbyists concerning drafting of significant federal trademark legislation, which was ultimately signed into law.
  • Advised client and lobbyists concerning drafting of significant copyright legislation.
