Litigation Strategies from a Different Viewpoint: Life as a Corporate Plaintiff
Check any corporate business plan, and you will find few, if any, that list litigation as a profit center. However, many have significant footnotes in their financial statements relating to defense of litigation. Litigation is typically a cost of doing business, even when a corporation is the plaintiff (like collection cases, non-compete enforcement, and intellectual property enforcement). A “bet the company” case is usually a defense case - ironically, not a bet any company would place on its own.
