Lathrop & Gage Wins Final Judgment in Right of Publicity Case
Lathrop & Gage attorneys Blaine Kimrey (Business Litigation – Chicago) and Bryan Clark (Business Litigation – Chicago) recently achieved final judgment in a right of publicity case on behalf of Noble & Associates, Inc., an advertising company, and Gerber Products Company, a major manufacturer of baby food and products.
The case, Abbs v. Lily’s Talent Agency, Inc., et al. was filed in the Circuit Court of Cook County in Illinois. The plaintiff claimed that Noble and Gerber violated her son’s right of publicity by using his image on Gerber promotional materials and merchandise without permission to do so. In August, the Court granted complete summary judgment in the matter thanks to efforts made by Mr. Kimrey and Mr. Clark.
The plaintiff, however, moved for reconsideration, but after argument by Mr. Kimrey, the Court denied reconsideration and entered final judgment for the firm’s clients.
Mr. Kimrey is a former journalist at two major metropolitan daily newspapers and has dedicated more than 15 years to working for and defending media entities. His practice extends well beyond media defense, focusing on a broad range of direct and class action commercial litigation involving topics as diverse as intellectual property, entertainment, insurance, banking, civil rights, telecommunications and mass catastrophes and torts. Mr. Clark’s practice focuses on media defense work, including class action mobile-marketing litigation and TCPA litigation. He also has been involved in a variety of pro bono engagements, including work for non-profit media entities and representation of Illinois prisoners with multiple sclerosis.
