6/30/2010
Lathrop & Gage attorney Carole E. Handler (Intellectual Property - Los Angeles) will be a featured panelist at Technology and Entertainment Convergence 2010 in New York on September 10, and San Francisco on September 22. Ms. Handler will be joined by Universal Music Group's Carla M. Miller in "Crossroads in the Bitmap: Litigation Impacting the Convergence of Entertainment and Digital Technologies." The day-long conference is staged by Practicing Law Institute, and features top entertainment practitioners and senior in-house attorneys in the industry.
The panel will address technology and digitization and their redefining of the nature of copying, creating new and instantaneous means of duplicating and transmitting content. Questions such as what can and must be protected, whether the rules themselves have changed, and the scope of fair use and how it is used by business entities will be the main purview of this session, which begins at 9:15 a.m. The two panelists will also address the respective responsibilities of ISPs and content owners to search out online infringement, the impact of technology on licensing "windows," and whether BitTorrent sites are by their nature infringing.
Ms. Handler has successfully tried landmark copyright, and antitrust cases in state and federal courts in California, New York and Pennsylvania as lead counsel. These have often involved the application of copyright principles to new technologies, and constitutional and antitrust cases involving motion picture licensing and distribution. Ms. Handler successfully led Marvel Entertainment in its recovery of the rights to its signature property, “Spider-Man.” She has served as Chair of the Copyright Litigation Committee of the American Bar Association, and has been named one of the "Top Women Litigators in California" by Daily Journal Extra every year since 1999. In 2001, she was named one of the "Lawyers of the Year" by California Lawyer, and was selected for inclusion in the 2007 - 2010 editions of The Best Lawyers in America.
A graduate of the University of Pennsylvania Law School, Ms. Handler is an adjunct professor at the University of Southern California Law School. There she teaches two antitrust courses, one of which focuses on the entertainment industry, and a copyright course on characters and superheroes in old and new media. She has also taught at UCLA Law School, and is invited often to speak and publish on a variety of copyright and antitrust issues. She has organized and participated in over one hundred seminars for PLI, Aspen, private companies and law firms, the ABA, the Beverly Hills Bar Association, the Los Angeles County Bar Association, the Bar of the City of New York, and law schools in California and New York. She is active in numerous pro bono activities in addition to her recent board memberships of the Los Angeles Chamber Orchestra, Los Angeles County Bar Association Dispute Resolution Services, and the Bet Tzedek Legal Services IP section.
