Stay for "Treaty Nationals” Extended to Three Years
The Department of Homeland Security has just amended its regulations to make it easier for professionals and skilled workers from Canada and Mexico to use the provisions of the North American Free Trade Agreement (“NAFTA”) to work in this country.
Under NAFTA, individuals in a variety of occupations, most professional in nature, have been able to come to the United States to work for U.S. employers using a streamlined procedure that is more “user friendly” than the normal immigration process. Individuals admitted under the NAFTA provisions are classified as “Treaty Nationals,” or TN workers. However, the period of stay for these workers has been limited to one year.
