Intellectual Property & Technology Law Journal Publishes Lathrop & Gage Attorneys on Bilski and Alternative Energy
Lathrop & Gage attorney Dave Barnard (Intellectual Property - Kansas City) and incoming associate Thyannda Mack authored "The Consequences of Bilski on Alternative Energy," published in the November 2009 edition of the Intellectual Property & Technology Law Journal. This publication, which is produced by Aspen, collects analytical articles from premier IP groups nationwide.
Of the legal analysis in the post-Bilski landscape, the authors write, "One area that has been overlooked is the sector involving renewable energy sources. There are a number of patents regarding methods of finding, harvesting, and utilizing sources of renewable energy like solar power, wind power and tidal power. Currently, the technology used in locating, harvesting, concentrating, storing and utilizing alternative energy sources is expensive. A lot of research and development has focused on making the use of these technologies more cost-effective, including developing methods and processes for ensuring that the technology is used efficiently."
Mr. Barnard is assistant head of the firm's Intellectual Property Litigation Department. Ms. Mack was a summer associate at the firm in 2009, and is currently finishing studies at the University of Iowa. She will be a member of the firm's Intellectual Property group in 2010.
In 2008, Missouri Lawyer's Weekly named Mr. Barnard as one of its "Up & Coming" lawyers under 40. He has also been named a "Rising Star" by Super Lawyers for the Missouri/Kansas region and has been named to the 2010 edition of Best Lawyers in America. His litigation work has included patent, trademark, copyright, trade secret and other commercial disputes in different courts throughout the nation. His business counseling practice has included assisting a wide range of companies - including intellectual property, entertainment, manufacturing, financial institutions, engineering, biotech, Internet, marketing and media clients - on matters as diverse as attracting venture capital, creating company-wide intellectual property identification and protection programs, noninfringement and freedom of operation opinions, creating comprehensive employee trade secret protection programs, licensing, assisting nationally-syndicated media clients with liability risk management and advising feature length film makers on intellectual property clearance, marketing and distribution rights.
