Phillip S. Lorenzo

Mr. Lorenzo has 30 years experience trying and litigating complex business and commercial disputes. His experience includes arbitration, trial, and mediation of large construction, fire subrogation and business matters throughout the United States. He has recovered numerous multi-million dollar awards for clients including construction contractors, insurance companies, architects, developers and other clients.

Construction Litigation

• Recovered more than $50 million on behalf of owner/developer of five-star hotel casino project in Las Vegas, Nevada. This case included multi-million dollar delay, disruption and defective work claims against an international general contractor, subcontractors and design professionals.
• Successfully represented general contractor and surety in delay, defective work and wrongful termination claims arising out of construction of municipal airport in Phoenix, Arizona.
• Recovered virtually all bond payments made by surety and obtained reversal from City contractor's termination for cause, reinstating contractor's bonding capacity. 
• Successfully represented an international architect in a dispute with the owner involving the expansion of one of the largest casinos in the United States.
• Regularly represents owners, developers, architects, general contractors and subcontractors in complex delay, disruption and defective work disputes.

Fire Subrogation

• Recovered more than $10 million on behalf of insurer in a fire loss that represented the largest personal lines loss in the history of the company.
• Recovered nearly $4 million from a products manufacturer in a business fire loss.
• Recovered more than $1.2 million following successful arbitration trial of a fire loss caused by defective construction. Arbitration award included 100% of insurance payments made, plus pre-judgment interest and attorneys’ fees.
• Obtained $1 million recovery following jury trial of fire loss caused by spontaneous combustion of construction materials during construction of multi million dollar town home penthouse project.

Intellectual Property­

• Represents plaintiff in patent infringement case in Colorado involving transdermal alcohol measurement device.
• Helps serve as principal outside intellectual property counsel for the leading retailer in the shoe business in the United States. Part of the legal team that handles patent (utility and design), trademark, trade dress, and copyright issues and all associated litigation, domestic and foreign.
• Obtained summary judgment in 2006 on behalf of a leading retailer in U.S. District Court in New Hampshire. At issue was a six-year multi-million dollar dispute over whether many of the company’s most popular product lines infringed on the plaintiff’s patented product design.

Complex Business Litigation

• Represented the uninsured creditors in the bankruptcy of an international general contractor.
• Successfully resolved multi-million dollar dispute between business owners in a case involving allegations of fraud and accounting malfeasance.
• Recovered nearly $2 million for an insurer in a dispute with an insurance broker.
