Adam Walker practices in the firm's Business Litigation Section and is a member of the Public Law team. He represents businesses in a wide variety of matters, including intellectual property litigation, real estate transactions, disputes arising under lease agreements, zoning and other land use hearings, and litigation of claims for life, health, and disability benefits under ERISA-governed plans and non-employer policies.
A significant portion of Adam's practice involves representation of transportation industry clients. He currently serves as Assistant General Counsel to the Kansas City Terminal Railway Company. In that capacity, he handles all aspects of litigation for the KCT, participates in contract negotiations and prepares a variety of legal and corporate documents. Mr. Walker also represents and advises the Kansas City Area Transportation Authority in several areas, including contract negotiations, real estate transactions and land use issues arising from KCATA's ownership of seven miles of a former railroad right-of-way, acquisition of real property rights necessary for the improvement and expansion of transit services, and legislative issues affecting public transit in the Kansas City metropolitan area.
Representative Experience
- Lead attorney in negligence action involving collapse of high-voltage power line onto railroad crossing protection and signaling equipment.
- Lead attorney in suit against property owner for damage to embankment caused by improper diversion of runoff onto client's property.
- Lead attorney in lawsuit for recovery of purchase money in case involving buyer's rejection of late-tendered merchandise.
- Represents international footwear retailer in trademark, trade dress, and patent litigation against other international retailers.
- Advised trust company retained as independent fiduciary regarding approval of proposed settlements in ERISA and securities class actions.
- Represented transit authority in connection with diesel-fuel supplier's attempted renegotiation of supply contract.
- Represented casino in successful defense of appeal involving the Missouri Gaming Commission's approval of client's site plan and continuous-docking authorization.
- Represented licensees in disciplinary proceedings before the Missouri Gaming Commission.
- Obtained summary judgments, dismissals, and favorable settlements on behalf of insurers, employers, and third-party administrators in numerous cases involving administration of 401(k) plans and claims for benefits under life, health, and disability plans.
