Mr. Ray has more than 15 years experience litigating complex commercial disputes nationally, including trial and appellate practice in state and federal courts as well as arbitration. His practice encompasses a variety of commercial cases including large loss property subrogation, construction disputes, and general commercial litigation.
Subrogation
- Represent multiple national carriers throughout the Western United States.
- Part of team that acted as regional subrogation counsel in a six-state region for a national carrier.
- His subrogation practice includes regularly handling large property losses involving construction defects, products liability, contract and general negligence claims.
- Speaker on various subrogation related topics.
- Won more than $1.2 million award for insurer in arbitration for fire loss caused by defective construction. Award included 100% of insurer’s payments plus interest and attorney fees.
- Obtained seven-figure settlement for fire at potato storage and processing facility. Settlement amount was 100% of insurer’s payments and insured’s uninsured losses.
Construction Litigation
- Represent property owners, contractors and subcontractors in construction cases including construction defect, contract disputes, and mechanics lien cases.
- Won $3.4 million jury verdict for client in lawsuit against contractor and developer for design and construction defects.
- Obtained favorable settlement for subcontractor in contractual interference claim arising out of construction of new Federal Reserve Bank building.
Complex Business Litigation
- Represent accounting firms in professional negligence cases.
- Represented real estate purchaser in litigation arising out of seller’s failure to disclose environmental issues.
- Won summary judgment declaring validity of uranium mining company’s in-situ uranium mining leases and successfully defended appeal of that judgment permitting client to retain leasehold interest in valuable uranium deposits.
- Collected settlement in excess of $1.3 million for aircraft maintenance facility for breach of aircraft maintenance and modification contract in parallel actions against major airline in state and federal courts.
- Obtained judgment for aircraft maintenance facility for post-bankruptcy petition services provided to debtor-in-possession airline.
- Represented aircraft owner and lessor in various contractual disputes both nationally and internationally.
