Justin Nichols

Mr. Nichols has extensive experience in banking and real estate litigation and regulatory fields, and focuses his practice on loan enforcement actions, consumer lending disputes, real estate purchase contract and lease disputes, regulatory matters, Fair Credit Reporting Act claims, bankruptcy proceedings and related litigated and non-litigated matters. He has been lead counsel for a national and regional lending institutions in litigation matters, is regional litigation counsel for a national real estate trust, and has successfully tried a variety of litigated matters. Mr. Nichols is also a leader in the Shawnee business and political community, with significant involvement in the Shawnee Chamber of Commerce. 

Significant Accomplishments

• Helped obtain trial verdict for return of $1.5 million earnest money deposit in real estate transaction, and attorney's fees. 
• Served on legal team representing a cattle owner that received a $1 million jury verdict in a cattle fraud case.
• Received favorable verdict at trial of breach of contract action and against counterclaim alleging hundreds of thousands of dollars in damages for tortious interference with business expectancy. Client received full amount requested.
• Obtained summary judgment in commercial arbitration by advertiser seeking hundreds of thousands of dollar in lost profits damages.
• Defended multimillion dollar counterclaim by successfully securing voluntary dismissal of all claims after protracted litigation and payment to our client. 
• Successfully negotiated settlement of breach of lease action which limited exposure of client to less than ten percent of claimed damages. 
• Defended and secured dismissal of claims against property appraiser in bankruptcy adversary proceeding alleging mortgage fraud. 
• Successfully defended limitation of liability provision in real estate purchase contract in briefing before Missouri Court of Appeals.
• Defended claims against regional lender alleging fraudulent inducement to enter into commercial guaranties on multi-million dollar loan package to dismissal.
