About the Program
For our sixth-annual State of Litigation conference, Professor Arthur Miller will provide insight into litigation trends to help in-house counsel prepare for disputes. Professor Miller will discuss new regulations, the effects of the recession on corporate litigation, increased ADR and its budgetary effects, and predictions for the future of litigation.

Lathrop & Gage's Jim Moeller will help untangle e-discovery as he presents new developments and techniques. He will discuss various forms of production for electronically stored information (ESI) and the host of considerations that counsel should heed, including document retention policies, vendor selection issues, and cost considerations. He will also provide a case law update focusing on the ever-changing ESI landscape.

A panel of local federal and state judges will discuss the biggest mistakes companies make in the courtroom, providing tips on the most common pitfalls companies encounter during litigation and how to avoid them.

In addition, talented Lathrop & Gage attorneys will provide their perspective on the latest trends in litigation, including:

  • Class-action litigation
  • Risks to companies from preferences, deepening insolvency and fraudulent transfers
  • Social media in the workplace and issues it presents to in-house counsel
  • Data integrity and privacy
  • Insurance coverage

A complimentary lunch will be provided. The program will conclude around 5:00 with a cocktail reception following.
